These Terms and Conditions govern your use of the Kaapse Liqueurs Online (Pty) Ltd website located at the domain name www.kaapseliqueurs.com. By accessing and using the Website, you agree to be bound by these terms and conditions which may be changed in the future without further notice (see updating of terms and conditions).
All the content on the Kaapse Liqueurs website, including text, graphics, logos, icons, designs, colours, layout and trademarks are the intellectual property of Kaapse Liqueurs and as such protected by South African and International Intellectual Property Law.
Alcohol Sales
Kaapse Liqueurs is an artisan business that supplies local 100% South African liqueurs and spirits.
By ordering and purchasing products that contain alcohol, you acknowledge that you are of legal drinking age.
The age at which wines may be sold and delivered to persons is legislated in each country. By ordering from the Website you affirm that you are at least of the applicable legal age and that the person to whom your wine will be delivered is also of applicable legal age.
Alcohol is not for sale to persons in South Africa, under the age of 18.
For this reason, positive identification may be requested and we may refuse an order at our discretion.
Delivery policy
Subject to stock availability and receipt of payment, requests will be processed within 7 working days, confirmed and handed over thereafter to a courier company for delivery to the address as given by you.
Kaapse Liqueurs will not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
Delivery charges and instructions are specified and requested on our order form. For very remote areas not serviced by standard couriers, Kaapse Liqueurs will be in contact with you to arrange an alternative address.
Kaapse Liqueurs will supply all goods to the courier company in good order.
Cancelled orders on the e-commerce facility will be refunded after deduction of a 20% charge for administration and packaging costs. This is providing the order had not been collected by the courier company. Kaapse Liqueurs reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient. Should Kaapse Liqueurs exercise this right, you will receive a full refund with no deductions.
International Delivery (outside of South Africa)
If you reside and live outside South Africa, it is totally your responsibility to check and comply with and pay for all duties, vat, customs requirements and legal documentation or charges relating to the importing of alcohol into your country.
Whilst we use the services of The Vineyard Connection, we cannot be held responsible for individual and local regulations pertaining to importing alcohol.
Kaapse Liqueurs uses VCExpress (Door to Door) international delivery for any online purchases, we can offer alternative delivery options to you by contacting us via email
Returns / Refund Policy
Whilst we do our utmost to provide as much information on our products, we are unfortunately not able to refund or exchange items that have already been dispatched.
However, if Kaapse Liqueurs delivered the wrong product, we require immediate notification of such, plus a picture of the incorrect order, which shall then be collected and replaced with the correct order at our cost.
Bottles that arrive damaged
When taking delivery of damaged bottles this is to be recorded on the receiving documents and we are to be notified immediately via email . Kaapse Liqueurs will then take it up with the courier company responsible for the delivery.
If you have employed the services of a local courier company (in your own capacity) it is your responsibility to take the matter up with them.
Payment Options
Credit card, EFT, and Snapscan.
Credit card transactions will be acquired for the Provider via approved payment gateways. Our payment gateways use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.
The merchant exporting country for payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Updating of these Terms and Conditions
Kaapse Liqueurs reserves the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is your obligation to periodically check these Terms and Conditions at the Website for changes or updates.
Limitation of liability
The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. We shall not be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.
Choice of Law
These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the Cape Town High Court in the event of any dispute.
Access to the Website from territories or countries where the content or purchase of the products sold on the Website is illegal, is prohibited. No one may not use this Website in violation of South African export laws and regulations. Anyone accessing this Website from locations outside of South Africa is responsible for compliance with all the importing countries local laws.
International Qualifiers
Kaapse Liqueurs is based in South Africa. All countries where the delivery address is outside of South Africa fall under our terms for international delivery.
The delivery charge is displayed when you view your cart before checkout.
Import duties and customs fees may be payable by recipients of international deliveries. As the customer, you will be responsible for both determining whether any such import duties/levies are payable, and making payment if required.
For international deliveries, we currently only accept payment via credit card, or bank transfers
Although you are able to see the price of a product in your currency of choice, all transactions are processed in South African Rands (ZAR) and therefore there might be minor discrepancies in amounts when it comes to the check out due to currency conversion process.
Depending on import regulations, restrictions and other factors, certain products will unfortunately not be available for delivery in countries outside of South Africa.
